Burress Charged
UPDATED (8:06 p.m.)...
New York Giants wide receiver Plaxico Burress made a court appearance today on weapon possession charges after turning himself in to police and being taken from a midtown Manhattan precinct in handcuffs.
Burress was freed after posting $100,000 bail and was scheduled to be back in court on March 31. He was not required to enter a plea today, although his attorney indicated earlier that he would plead not guilty. He faces a potential jail sentence of 3-1/2 to 15 years after being charged with two counts of second-degree criminal possession of a weapon.
The Super Bowl standout suffered a thigh wound after reportedly shooting himself in the leg accidentally early Saturday morning. The incident occurred at a New York nightclub at which Burress showed up carrying a gun that he was not properly licensed to carry, according to reports.
Police were investigating the role of Giants linebacker Antonio Pierce, who was with Burress at the nightclub, in the shooting, and New York Mayor Michael Bloomberg told reporters that he wanted to see Burress prosecuted "to the fullest extent of the law."
Burress did not speak during his court appearance.
He reportedly arrived at the police station in the morning in a black Cadillac Escalade, wearing jeans and a black coat. His attorney, Benjamin Brafman, told reporters outside the 17th Precinct station that Burress would plead not guilty to the charges.
"He is standing tall," Brafman said, according to the Associated Press. "He is a mature adult. I think any professional athlete in this situation would be concerned."
Brafman told reporters that many of the media portrayals of the incident had been inaccurate. He said he's hopeful that Burress will be able to resume his NFL career soon.
"If they let him play, he will be able to play.... I think he will be a superstar for the rest of his career," the high-profile attorney said, according to the AP.
"My hope is that it plays out well and he can continue his career because he's a good person, I think, with a brilliant athletic career. And it would be a terrible sadness if an isolated incident could ruin a life."
Two New York newspapers, the Post and Daily News, reported over the weekend that, according to records, Burress did not have a permit to carry a gun in New York. Burress had a concealed-weapon permit issued to him in Florida but records showed that it expired in May and New York does not recognize out-of-state permits anyway, the newspapers reported.
According to the criminal complaint against Burress, a witness heard a popping sound and saw Burress's legs begin to shake, then saw a bloody gun fall out of his pants onto the floor. Police indicated that Pierce left the nightclub, named the Latin Quarter, with Burress.
Burress later was treated at New York-Presbyterian Hospital/Weill Cornell Medical Center. He reportedly was released from the hospital Saturday afternoon.
Police originally indicated it was thought that Giants running back Derrick Ward was with Burress and Pierce at the nightclub. But Ward denied he was there and police later indicated that was unclear. NBC reported Sunday night that Giants running back Ahmad Bradshaw, not Ward, was with Burress and Pierce but was not involved in the incident.
Burress also faces possible discipline by the NFL. The league's gun policy warns players that carrying an unlicensed firearm could result in disciplinary action by the league. Giants Coach Tom Coughlin told reporters in a conference call that the team had not decided what its response would be. Club officials were discussing the issue, Coughlin said. The Giants suspended Burress for one game without pay earlier this season after he missed a team meeting, and Coughlin benched him for a little more than one quarter of another game after he missed a treatment session.
The Giants signed Burress, 31, to a five-year, $35 million contract hours before the opening game of the season. He caught the winning touchdown pass in last season's Super Bowl upset of the previously unbeaten New England Patriots.
It's not clear when Burress might be healthy enough to play football again. One report over the weekend indicated that Burress had been told by doctors he might be able to play within a couple weeks.
Pierce played in the Giants' victory Sunday over the Washington Redskins at FedEx Field, which improved the team's record to 11-1. Burress did not play against the Redskins. The Giants had ruled him out Friday because of a previous hamstring injury.
Bloomberg has been a staunch supporter of tough gun laws and told reporters at an unrelated public appearance, according to the AP: "I don't think anybody should be exempt from that, and I think it would be an outrage if we didn't prosecute to the fullest extent of the law, particularly people who live in the public domain make their living because of their visibility. They're the role models for our kids."
Bloomberg also said it's "just an outrage" that the hospital might not have properly reported its treatment of a gunshot wound to the police, as required by law. Hospital officials indicated they were investigating.
The Giants also issued a statement indicating they were cooperating with the police investigation and NFL security officials, that after police representatives expressed frustration about their dealings with the team and Pierce.
Pierce said during a radio interview today that he had an attorney but did not envision himself being arrested.
Police sources alleged to the Daily News over the weekend that Pierce had taken the gun after the shooting and put in somewhere in New Jersey.
According to authorities, the gun--a .40-caliber Glock--was recovered at Burress's home in New Jersey.
According to reports, police had believed that Pierce would appear at the same station today that Burress did, but Pierce didn't show up and investigators couldn't locate him at his New Jersey home. A Giants representative reportedly was at the police station, however.

The problem is not that he was carrying a gun to defend himself, It is that he shot it off in a crowded nightclub and very easily could have killed numerous people. Of course you have you second amendment right to carry a weapon but no one has the right to shoot it in a crowd of innocent bystanders. A permit is also necessary as for anything of this sort. The combination of the two determines his sentence, not the mayor being a 'hard ass'. NOTHING is more important then prosecuting fools who are not responsible enough to carry a weapon and shoot it off in crowds of people. Hardly a waste of my tax dollars.

What ever happened to the second Amendment. This man had every right to carry a weapon. He is a multimillionaire carrying a weapon for possible protection...He deserves the protection of his 2nd amendment right to bear arms as does every American. When did it become a fking crime to accidentally shoot yourself.
What a waste of the tax payers money by showboating politicians and prosecutors. There are many more important things that need to be taken care of than this non-sense that is going to tie up millions of dollars of the taxpayers money.

THE RODENTMAN: I agree with your first statement: the restrictions are in place. I just had a problem with some commenters upset because they thought their 2nd Amendment rights were being revoked or something. That the criminals would all have guns and they wouldn't which of course is not correct. Burress wasn't attacked by a criminal. I don't need a permit. I find an axe handle will work just fine in a crisis. I've seen some people were a gun is a substitute for balls.

The fact is that there are many reasons to carry a concealed weapon if "Joe Citizen" is properly trained and has the requisite permit, as I do.
When you can guarantee me that criminals will not have guns I will be more than pleased to turn mine in. When you can guarantee me that criminals will not have knives or other weapons, I will reciprocate.
I grab my keys, wallet, and gun when I leave the house. No, I don't need a cell phone. I do it every day and always will. I do not patronize businesses that are posted.

I did not say prohibit firearms, I said restrict firearms, as they were in this case: he did not have a permit in New York and were technically not allowed in the bar. Same with fully automatic weapons, people with mental problems, in Federal buildings, etc. No one is saying prohibiting, just restricting which just makes good sense.

Burress is an idiot. Too much money too quickly, too much fame too quickly, too much idiolizing of athletes and giving them big contracts while other professionals with much more education struggle financially, and too much lack of intelligence on their part as to how to handle it all, and that is the ruination of a career. No sympathy for one who has it all and throws it away as a result of stupidity.

Remember, this is about Burress and his behavior. It is not about guns or the behavior thereof.
The 2nd ammendment guarantees the right to keep and bear arms. With the proper permit, one can carry a concealed weapon, or even open carry.
I have such a permit and carry wherever it is not prohibited by proper posting.
There is not one shred of evidence that an increase in the number of law-abiding citizens carrying has caused an increase in crime.
To the antis: If he had stabbed himself with an icepick would you want to restrict icepicks?

The Second Amendment secures the right to keep and bear arms ostensibly for the protection of the nation. Restrictions on who, where and what firearms are carried is certainly in my best interest. I haven't carried a firearm since 1970 in Quang Tri province and have had no problems protecting my family and property. People with guns scare me and this story is the reason why.

Funny how Vick gets 2 years in jail plus additional suspensions but guys like Ray Lewis, Tank, Pac Man, Pierce and Buress get a slap on the wrist for endangering human beings at public clubs. Just imagine if your son or daughter was partying at one of these clubs... They could get killed by a stray bullet. Time to ban Vick, Ray Lewis, Pac Man, Tank, Pierce and Burress from the NFL forever. One strike and you are OUT. Many good young men are waiting on the bench ready to take their places on the football field.

Okay let me preface this with:
• I'm a father of 3 small children • I'm fairly religious • I'm a high school teacher • have never actually had a real gun (supposed once) waved in my face • I'm historically opposed to guns • I've never owned a gun or fired anything stronger than a .22 rifle at scout camp...
Now that that's out of the way, I'm starting to understand the mentality. Read this story and tell me it doesn't at least make you understand. Though I don't think I'd ever actually go through with it, it at least gives some creedence to gun ownership. And yes, I know goofy ass Plaxico didn't have a permit.

It is a simple fact that the law states that no one can carry a conceled handgun in a business where 51% of the revenue is from alcohol.
It is a shame that these athletes take their opportunities and just waste it. There are others out there just wanting the chance.

Be interesting to find out why he needed protection in the first place. I think it's safe to say that that gun was not crammed in his pants for any honorable reason. Sure making his family proud.

I take issue with "Gun Shy" suggesting that he shouldn't be suspended because he only hurt himself and not others.
The only difference between hurting himself and hurting/killing someone else is that everyone else was just lucky that the gun went off while it was still pointing at him...a few degrees either way and someone other than this dumb*ss could've easily been hurt in a crowded nightclub. Why should he get any special consideration for the fact that he was lucky enough to shoot only himself?
And as far as I know, the NFL does NOT have to abide by "innocent until proven guilty" when determining suspensions for this type of behavior, and have stated that fact in this case. Of course, the player's union will most likely appeal, Plax will play once he makes bail and heals--and decides he feels like showing up for practice--and the spotlight will shift to a more current athlete-falls-from-grace story while he quietly makes a deal with prosecutors in a couple months.

...that's not the point here, even if he had a CCW permit to carry the weapon it probably would not apply in a nightclub, it's still illegal to bring weapons into an establishment that serves alcohol. And likely the bar would not have allowed it, knowingly.
Second, why go to a nightclub if you feel the need to bring a gun for protection? It's like he hasn't been *listening* to the whole Pacman saga, I'm sure the NFL has player-reps and staff to warn the players about the dangers, the Richard Collier situation, all the guys who have gone to clubs and gotten into fights or gotten shot or stabbed...to take a gun with you into a nightclub says that you know that there's a good chance that you will need to defend your life if you go there. So why go there!!!
He's a tier1 pro athlete he has to accept what comes with the territory. Then shoot YOURSELF with the gun! He'll be lucky if he gets out of this with a suspended sentence. And certainly if he gets convicted for a crime with possible punishment over 1 year, he's not allowed to carry a gun AT ALL. That's it: done, finito.

I no longer support professional sports. The pay is out of control as are their egoes.
The punishment should be tougher for these sport players. Why? Because children idolize them and want to be like them (unfortunatly), they need to see that the higher you are, the further you fall.

This is nothing more than abject stupidity. It is becoming more evident each and every day that the only IQ test required of them is that they can understand the playbook.
Burress represents that mentality when he decided to plead 'not guilty' with a bullet hole in this leg and no permit. And if he has/had a lawyer who advised him to plead in that manner that lawyer needs to have his license pulled for he too, is just as stupid.

Let's not forget that everyone uses that word and you have no way to know color on the Internet. It is just as ignorant to assume all racists are white as it is to improperly handle fire arms in public. He should be reasonably punished regardless of wealth or color. First ammendment rights should stand regardless. Mind your own business and the world is a safer place. Crime drops in cities with ordanances requiring gun ownership. Go figure.

To break a law that is unconstitutional is not breaking a law at all is it? Shouldn't the lawmakers who wrote the laws be charged for violating the constitution? The constitution is what this country was founded on and no one has the right to change it. If you had as much money as an NFL player I bet you would want to carry a gun too; I would. Criminals carry guns and they won't hesitate to shoot you with them; shouldn't you have the right to shoot back? This guy is not a criminal. He is just an American practicing his right to carry a firearm to protect himself. He is an idiot for shooting himself and I cannot disagree with anyone who says that, but it doesn't mean he did anything "wrong"; he had no intentions of hurting anyone only protecting himself. This appears to be an innocent lapse in judgement...one for which no penalty should be assigned. We all make mistakes...no one was hurt other than himself. If it happened to a person without noteriety, we would not hear anything about it. Leave the guy alone. This was not a serious enough offense to warrant ruining his career. As a New Yorker, I am furious. We have budget deficits galore, and we are wasting money on this foolishness. If one cent of my taxpayer money is spent of jailtime for Buress, I will be livid.
Now that said, fine the hell out of him. We could use the money, and I'd rather him for carrying a gun than my speeding ticket.
The NFL has the right to suspend him. Although, it is not a very serious issue.

99% of these comments are baseless and pathetic.
The guy committed a firearms offense and should be charged and face conviction. It is his right to plead however he wants, guilt or not guilty.
Also, for all of these "anti gun" comments -- Guess what!? -- my concealed weapon goes everywhere. It's just like a wallet, gets tossed in the belt holster just like keys in pocket before heading out the door.
Which means, it goes to the bank, grocery store, toy store, etc -- it just doesn't goto Federal buildings, schools and places which server alcohol (don't drink anyway...).
It even travels with me on occasion, as long as it is legal to do so.
He obviously made a seriously poor decision that will effect him for quite some time, but this has NOTHING to do with gun rights, laws, etc.
If you disagree, then we should definitely ban computers, cars and the air we breathe because someone, somewhere has used them to break the law!

Does anyone remember the above? It seems to me that the people who founded this country did not intend for there to be such a thing as a concealed weapons permit.
If he is guilty of anything, it is stupidity and improper handling of his weapon. I would sentance him to firearms safety classes and make him get a better method of carrying his gun.
We all have the right and the duty to defend ourselves and our families. I for one will not sit around helplessly waiting for the government to take care of me in any circumstances.
If you are afraid of guns, why don't you go to a shooting range? You will find that the people there are very helpful and some of the nicest people you will meet. You might also find that guns are not really so scary and are in fact very useful in the right hands.

He should get whatever the court wants to throw at him. Some say he should get off because he only shot himself. He already, luckily, got off by shooting himself. Had the bullet not hit his leg, surely someone else would have taken that bullet in a crowded nightclub. He would have faced possible murder at that point. Give him some jail time and maybe the next idiot athlete with a gun will think twice.

This is the problem with hand guns. Plexico is obviously not educated how to safely handle his firearm. If he was, it would have never slid down his pant leg and been in a place where he needed to fumble around with it until he shot himself. He could have just as easily shot one of the many many patrons likely dancing and having a good time at the club that night. There is also the issue of the unresolved Pac-man Jones night club shooting. An innocent man will spend the rest of his life unable to walk. Even with that injustice fresh in them in mind of the collective public, Burress chose to put himself and others in danger by bringing a loaded gun into a club. He deserves his day in court to explain his side, but if he is indeed guilty, he deserves the maximum punishment allowed by law.

Why? Did he commit a crime against another person? Yes, carrying the gun was illegal in NY, and he should face charges, jail time, fines, etc., as appropriate. But he shot himself, not someone else. He wasn't hurting anyone but himself. Most other players that are suspended are doing something stupid to someone else. That's stupid. All Burress did was use poor judgement.

See that's the problem, they make too much money and they think they are above the law. They can do what ever they want to do. No one else could have gotten into a club careing a gun. To all us average joe's we feel the law is not being handed out fairly because of their money and prestiage that comes with their celebrity. They are above the law. The court systems proves that.

Upon further review, the call on the field stands. The player had possession of the gun before he stepped out of bounds. The Giants will be charged a timeout.

I could understand him being charged if this is a "minimum mandatory" charge in N.Y. which I don't know. If it is not and he hasn't had any priors, I highly doubt he goes to jail at all. He might receive felony charges at the most. With no mandatory minimum, he will walk like T.I. A rapper from Atlanta who was caught with several machine guns and served only community service and time served as far as i know. Life and the law is and has always been different for those with money, and especially when you couple that with fame.

That's pretty funny, He shoots his self and then wants’ to plead not guilty. Not only should he be charged with possession of an illegal weapon he should be charged with being too stupid to own a gun considering he shot his self. Since he feels he's not guilty and wants’ to go to court then he should serve the entire mandated sentence for wasting our time.

It is amazing when a person of his fame does well everyone is on the bandwagon. When a person takes a fall now he is an idiot and stupid. I am sure there are many individuals in this world who make mistakes knowingly to the world and unknowingly. And if the law knew the criminal acts many individuals have committed, you would feel what he is going through. Society always remembers the wrong we do in our lives but through prayer and repentance, GOD throws those unfortunate mistakes in the sea of forgetfulness through the blood of Jesus.
